By using Kerbmile you agree to these terms. If you do not agree with them, please do not use the app.
What Kerbmile is
Kerbmile is a record-keeping tool. It records your business mileage, reads your receipts, keeps your income by week, and prepares figures for Making Tax Digital for Income Tax.
What Kerbmile is not
- It is not an accountant, and it is not tax advice. Every figure it shows — your deduction, your profit, what to put aside — is an estimate produced from what you have entered. It cannot know about income, costs or circumstances you have not told it about.
- It is not endorsed by or affiliated with HMRC. HMRC does not approve software. Where Kerbmile is listed by HMRC as compatible, we will say "recognised" or "compatible", never "approved".
- It does not file your return for you without you. You check your figures and you send them. What you file is yours.
What you are responsible for
The accuracy of your records, and what you submit to HMRC. Kerbmile can only work with what it is given: drives it was allowed to see, receipts you photographed, income you entered. If a figure is wrong because something was missing, miscategorised, or mistyped, that is still your return.
Specifically, you are responsible for:
- Checking figures before you rely on them or send them.
- Keeping your own records. HMRC expects business records to be kept for five years after the 31 January filing deadline. Kerbmile is built to help you do that, and you should still export your records periodically.
- Meeting your own deadlines. Kerbmile shows deadlines and may remind you, but a missed deadline is between you and HMRC.
- Using the app lawfully, and not attempting to break, overload or misuse it.
Your account
You need an account to use Kerbmile. It is for one person — yours. Sign-in is by a code emailed to you, so keep access to that mailbox secure: anyone who can read your email can reach your records.
You must be 18 or over.
Paying for it
Some features may require a paid subscription. Where they do:
- The price, the billing period and what is included will be shown before you pay.
- Subscriptions are sold through the App Store or Google Play, and are billed, renewed, cancelled and refunded by them under their terms. Manage or cancel a subscription in your Apple or Google account — we cannot do it for you.
- If we change the price, we will tell you before it takes effect and you can cancel.
Availability
We try to keep Kerbmile working and your records safe, and we cannot promise it is never unavailable. The app records your drives on your phone and works offline; syncing, backup and anything involving HMRC need a connection and depend on services we do not control.
We may change or remove features. If a change materially reduces what you have paid for, we will tell you before it takes effect.
Your records
Your records are yours. What we hold, where it lives and how to get rid of it is in the privacy policy.
You can export your records at any time, and you can delete your account from inside the app. Deletion is immediate and permanent, so export first if you may still need them.
Where we stand on liability
Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, your statutory rights are not affected by anything here.
Beyond that: Kerbmile produces estimates from the information you give it, and we are not liable for tax, interest or penalties arising from figures you submit. That is the honest position — we cannot stand behind the accuracy of a return built from records only you can verify.
We are not liable for losses caused by something outside our reasonable control, or for records lost because you deleted your account or lost a device without a backup enabled.
Ending it
You can stop using Kerbmile at any time, cancel any subscription through the store you bought it from, and delete your account in the app.
We may suspend or close an account that is being used unlawfully, or in a way that damages the service or other people using it. If we do, we will tell you why, and where the reason allows it we will give you the chance to export your records first.
Changes to these terms
If these terms change in a way that affects you, the app will tell you before the change takes effect. Continuing to use Kerbmile after that means you accept the new terms.
Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you keep the protection of the consumer law where you live and can bring proceedings there.
